An Arizona behavioral health facility license is the authorization the Arizona Department of Health Services (ADHS) issues under Title 9, Chapter 10 of the Arizona Administrative Code before a behavioral health residential facility or counseling facility may operate. This page is for owners and administrators of start-up programs. Integral Healthcare Solutions (IHS) drafts the application content, the policy and procedure set and a mock survey. Your organization approves them and files.
What is Arizona behavioral health facility licensing?
It is state licensing of a health care institution under Title 9, Chapter 10. We read the official text in 9 A.A.C. 10, Supplement 26-3 (September 30, 2026) (page opened 2026-11-06). The counseling facility definition points to 9 A.A.C. 20, Articles 1 and 2, for the requirements of DUI and misdemeanor domestic violence offender programs.
Rule R9-10-102 lists 27 classes and subclasses a person may apply for, including the behavioral health residential facility, the counseling facility and the outpatient treatment center. It also says the applicant must apply for the class or subclass that authorizes the highest level of physical health or behavioral health services the institution plans to provide, and that the Department reviews the proposed scope of services to decide whether the requested class is appropriate.
The two classes this page covers
- Behavioral health residential facility (Article 7). A health care institution that provides treatment to an individual experiencing a behavioral health issue that limits the individual's ability to be independent, or that causes the individual to require treatment to maintain or enhance independence.
- Counseling facility (Article 19). A health care institution that only provides counseling, which may include DUI screening, education or treatment and misdemeanor domestic violence offender treatment.
How the review runs
ADHS says on its Behavioral Health Provider Resources page (page opened 2026-11-06) that all renewals and applications must be submitted electronically using the Licensing Management System and that it no longer accepts paper forms. Under R9-10-108, an application packet is not complete until the applicant gives the Department written notice that the institution is ready for a licensing inspection. Table 1.1 then gives the Department 120 calendar days overall: 30 for administrative completeness and 90 for substantive review, with the clocks suspended while the Department waits for missing items. The Department may inspect during substantive review and sends a written notice of approval to an applicant that is in substantial compliance with Title 36, Chapter 4 of the Arizona Revised Statutes and Chapter 10. The Department issues the license after the applicant pays the license fee.
Who needs it and what triggers it
R9-10-103 requires a license for each health care institution facility except a facility exempt from licensing under A.R.S. § 36-402 and an administrative office, so a program that plans to operate in one of the listed classes checks that exemption first. Common triggers follow.
- A start-up residential or counseling program is preparing its first application.
- An existing provider is adding a class or subclass. R9-10-109 requires a new license application for a change in class or subclass.
- An owner is changing ownership or moving. R9-10-109 requires a new application for a change in ownership and for a change in the address or location of an institution that provides behavioral health services.
The first decision is the class, because the supplemental rules and the license fee follow from it. Your service plan, ADHS and your counsel settle it.
What does the application packet require?
R9-10-105(A) lists the initial packet: the application with the facility name, address, tax ID number and requested class, whether the facility is ready for inspection and, if not, the date it will be, owner information, the governing authority, and the chief administrative officer's name, title, highest degree and related experience. It also requires documentation from the property owner that the owner approves the institution to operate and has exclusive rights of possession, organizing documents if applicable, the proposed scope of services, and the physical plant route: either an architectural plans application under R9-10-104 or, where the institution is not required to follow the incorporated physical plant codes, local building and zoning documentation, a certificate of occupancy or, if local documentation is not available, documentation of that and a general contractor's inspection stating the facility is safe for occupancy, the requested licensed capacity, a site plan and a floor plan.
R9-10-105(B) adds the class supplement. A residential facility states under R9-10-702 the ages it will serve with the requested capacity and any request for personal care, respite or an outdoor behavioral health care program, and obtains a separate license for each single dwelling unit. A counseling facility states under R9-10-1902 its days and hours of clinical operation, any request to provide DUI or domestic violence offender services, and any affiliated outpatient treatment center or shared administrative support.
How IHS helps
IHS prepares the documents and the rehearsal, and your organization makes every decision and filing. IHS works in three practice lines: accreditation consulting, compliance services and program development. Thomas G. Goddard, JD, PhD, founder of IHS and former URAC Chief Operating Officer and General Counsel, leads the engagement personally.
What IHS drafts
- A readiness review of your plan against the rules for your class.
- The application content and an evidence map tying each packet item to a document in your files, including the scope-of-services statement and the class supplement.
- The policy and procedure set, with clinical content drafted for your clinicians to review and approve.
- A mock survey with findings and drafted corrections.
What you supply
You supply ownership and governing documents, the administrator and clinical lead, the service list, staffing and credentials, insurance and financial records, control of the premises, and clinical sign-off on every clinical policy.
The real limit
IHS does not decide whether ADHS will license your facility. IHS does not file your application and does not contact ADHS for you. Your organization files and handles all contact with ADHS.
What to have ready
Each item cites the rule it follows.
- One class decision (R9-10-102).
- Owner entity, governing authority and chief administrative officer information (R9-10-105(A)).
- Written approval from the property owner and proof of exclusive rights of possession (R9-10-105(A)).
- Architectural plans or local building and zoning documentation, with a site plan and floor plan as the route requires (R9-10-104 and R9-10-105(A)).
- The scope-of-services statement and the class supplement (R9-10-702 or R9-10-1902).
- A written administrator qualification standard, a designated administrator and an acting administrator plan for absences of more than 30 calendar days (R9-10-703(A) or R9-10-1903(A)).
- For a residential facility with a licensed capacity of 10 or more residents, or a request for it, a designated clinical director who is a behavioral health professional (R9-10-703(D)).
- A documented quality management plan with a report to the governing authority, kept at least 12 months after the date the report is submitted to the governing authority (R9-10-704 or R9-10-1904).
- Policies and procedures reviewed at least once every three years and updated as needed, and documentation required by the article ready to provide within two hours after a Department request unless otherwise stated (R9-10-703(C) or R9-10-1903(D)).
- A current fire inspection, with repairs made and documentation kept (R9-10-720(C) or R9-10-1910(D)).
- The 50 dollar application fee, and a plan to pay the license fee within 60 calendar days after the written notice of approval, or within 90 with a 250 dollar late fee (R9-10-106 and R9-10-107).

How it compares
State licensure answers a different question from accreditation or payer enrollment, and you may need more than one.
- Arizona license. Required to operate in the class. ADHS issues it under Title 9, Chapter 10. Our Washington behavioral health agency licensing page covers another state's license.
- Accreditation. A private body's review. Our ACHC behavioral health page covers one example. An accreditation review does not replace the ADHS license.
- Medicaid enrollment. The ADHS provider page has a section on the Arizona Health Care Cost Containment System (AHCCCS). We did not open enrollment requirements, so ask AHCCCS.
We do not tell you which to pursue. Your leadership and counsel decide that.
What it costs
A start-up pays three kinds of cost: the authority's fees, consulting fees and your own staff time.
- The rule sets a nonrefundable application fee of 50 dollars (R9-10-106(A)). Table 1.3, amended effective August 5, 2026, sets the license fee for a behavioral health residential facility at 495 dollars for no licensed capacity or 1 to 59 beds, 990 dollars for 60 to 99, 1,485 dollars for 100 to 149 and 2,475 dollars for 150 or more, plus the licensed capacity times 132 dollars. A counseling facility is 495 dollars. Verify current fees with ADHS.
- Consulting fees depend on scope. IHS scopes each engagement after a free introductory call.
- Your owners and administrator gather documents and your clinicians approve every clinical policy. That time is yours whether or not you use a consultant.
What this is not
- It is not legal advice. IHS is a consulting firm, not a law firm.
- It is not a guarantee that ADHS will license your facility. ADHS decides.
- It is not filing or liaison work. IHS does not submit to ADHS and does not contact it for you.
Frequently asked questions
Which Arizona license does a behavioral health program need?
It depends on what the program will provide. The rule lists 27 classes and subclasses and requires the applicant to apply for the class that authorizes the highest level of physical health or behavioral health services it plans to provide. Residential treatment points to Article 7. Counseling only points to Article 19.
What is the difference between a behavioral health residential facility and a counseling facility?
A residential facility treats individuals whose behavioral health issue limits their ability to be independent or requires treatment to maintain or enhance independence. A counseling facility only provides counseling, which may include DUI screening, education or treatment and misdemeanor domestic violence offender treatment.
What does the initial application packet contain?
It contains the application with facility, ownership, governing authority and chief administrative officer information, property owner documentation, organizing documents if applicable, the physical plant documents, the proposed scope of services and the application fee, plus the class supplement. Confirm the current screens in the ADHS Licensing Management System.
Is a fire inspection required?
For both classes the administrator must obtain a fire inspection conducted according to the timeframe established by the local fire department or the State Fire Marshal, make any repairs or corrections stated on the report and maintain documentation of a current fire inspection.
What does an Arizona behavioral health license cost?
The application fee is 50 dollars and nonrefundable. The residential facility license fee is 495 dollars for 1 to 59 beds, up to 2,475 dollars for 150 or more, plus the licensed capacity times 132 dollars; a counseling facility pays 495 dollars (Table 1.3, effective August 5, 2026). Verify current fees with ADHS. IHS scopes each engagement after a free introductory call.
How long does ADHS take to decide?
Table 1.1 gives the Department 120 calendar days overall: 30 for administrative completeness and 90 for substantive review. The clocks are suspended while the Department waits for missing items. An extension by written agreement may not exceed 25 percent of the overall time-frame.
Does ADHS require a clinical director?
For a residential facility, yes in one case: if an applicant requests, or the facility has, a licensed capacity of 10 or more residents, the administrator designates a clinical director who provides direction for the behavioral health services and is a behavioral health professional. We did not find a parallel rule in the Article 19 sections we read.
How is the application submitted?
ADHS states that all applications must be submitted electronically using its Licensing Management System and that it no longer accepts paper forms. Your organization submits and handles all contact with ADHS. IHS does not file for you and does not contact ADHS.
